Becoming a legal guardian in Oklahoma

Not everyone is able to take care of themselves, whether it is because of age, illness or disability. That's where legal guardianship comes in.

A legal guardian is someone who is assigned full power and control over the health, safety, property and finances of another individual when the individual is not able to do so himself or herself.

A guardian may be assigned by the court, set out in a will or granted by a power of attorney document. Legal guardians are often assigned in one of the following situations:

  • A child under the age of 18 is being raised by someone other than their parents (which could include temporary guardianship while parents are deployed);
  • An elderly person who is incompetent or unable to manage their own affairs; or
  • A special needs or disabled individual who cannot manage his or her own affairs.

The purpose of establishing legal guardianship is to put a trusted person in charge of making important decisions and taking responsibility for the life of a minor or a vulnerable adult.

A legal guardian can help with all of the following:

  • caring for a child;
  • managing health care decisions and medical appointments;
  • administering medication;
  • working with the insurance company; and
  • handling personal finances.
